Who Are Best Companies Data Processors, Or Your Sub-Processors?

Best Companies works with other organisations to enable us to provide you with the best possible service. Read on to learn more about our Data Processors and Sub-processors.

Use of Sub-processors 

Like most organisations, Best Companies works with other organisations to enable us to provide you with the best possible service. These third-party suppliers perform the particular functions described below and are considered sub-processors under applicable data protection laws (“Sub-processors”), including the European Union’s data privacy regulation known as the General Data Protection Regulation (aka GDPR). Please find a list below of the organisations we use to process your data. In accepting our Terms of Service you consent to our use of existing Data Processors. 

 Best Companies Sub-processors: 

  • Barracuda Networks Ltd, Reading, England, UK

  • Microsoft Ltd, London, England, UK

  • Salesforce, Sweden

  • Mailgun Technologies, Germany 

  • Zivver Limited, Republic of Ireland and Germany

  • Atlassian Jira Service Management, Ireland and Germany

  • HubSpot, Germany* 

*  SyncMatters and Pixel Lab: Will be providing these temporary processor services to assist with the migration of data from Salesforce to HubSpot. (Location of data storage – Germany) 

As part of the service provision some of the data processors may transfer the data to a different country than stated above e.g. for Geo-redundancy. For the avoidance of doubt the transfer will only be within the European region. 

Best Companies will not transfer the Personal Data of which the client is Data Controller – or permit any processing by Sub-processors – in any country outside of the United Kingdom and/or European Economic Area (as it is made up from time to time). 

Services supplied by Sub-processors 

Should we look to employ a new Sub-processor or replace an existing Sub-processor while you are in contract with us, we will inform you with a minimum of 30 days’ notice. This will provide you the opportunity to reasonably object to us employing the Sub-processor for our services. 

  • Microsoft Azure and SQL database: Required to host Supplier live websites and to store and process the site files and data. 

  • Barracuda Networks: The data which is held in our on-premise server cluster, is replicated securely to the Barracuda data centre to provide our offsite cloud backup. 

  • Mailgun Technologies: Required to manage our transactional email delivery to clients. 

  • Salesforce: Provides Best Companies services to maintain business operations and customer relationship management. 

  • Zivver Limited: Provides Best Companies and our clients with a secure communication platform to transfer large files or confidential information to Best Companies, and transfer data, securely to an individual or Organisation.  

  • Atlassian Jira Service Management: Provides Best Companies services to maintain business operations and IT service management. 

  • HubSpot: Provides Best Companies services to maintain business operations and customer relationship management. 

All data processors have appropriate Agreements in place that contain the GDPR mandatory clauses required for data processors. 

To object to a new sub-processor 

A client may object in writing to the processing of its Personal Data by a new sub-processor within thirty (30) days following the notification and such objection must describe the clients legitimate reason(s) for objection. If client does not object during such time period the new sub-processor(s) shall be deemed accepted. 

 If a client objects to the use of a new sub-processor pursuant to the process provided under the Agreement, Best Companies shall have the right to cure the objection through one of the following options (to be selected at Best Companies sole discretion): 

  •  Best Companies will not use the new sub-processor and make alternative arrangements where possible with regard to personal data being processed in its role as data processor; 

  •  Best Companies will take the corrective steps requested by Client noted in its objection (which steps will be deemed to resolve Client’s objection) and proceed to use the sub-processor to process Personal Data; or 

  •  Best Companies may cease to provide services or Client may agree not to use (temporarily or permanently) the particular aspect of the Service that would involve use of the sub-processor to process Personal Data.

  • January 2025: Addition of Sub-Processors HubSpot and SyncMatters (Temporary) and Pixel Lab (Temporary) (Commencing February 2025)
